1. Mission

Whether we like it or not, sex work has always been an integral part of our societies. The decriminalization of sex work passed in March 2022 offers an opportunity for an entire sector to emerge from the shadows. However, many things remain to be put in place to allow its members to exercise in complete normality. While this step remains a remarkable advance from a political and societal point of view, it is still the case that attitudes will have a hard time accepting it. We want to facilitate this transition towards acceptance.

With BUNNIZ, we are creating an efficient exchange platform between all members. Clients and sex workers are equal and can find contacts through their profiles. The automated agenda facilitates scheduling appointments. The messaging system offers the possibility for sex workers to converse with clients. The rating and commenting system allows members to evaluate each other after their meetings. Experiences are published in the profile and offer a better view of the quality of the workers.

At BUNNIZ, pleasure with safety is a priority. Safety is based on 2 axes: protection against all forms of violence, and the health of our members. This protection will be exercised at 3 levels: during registration, transaction, and rating. The information collected will allow us to easily identify troublemakers and take any necessary sanctions. As an operator, we also want to raise awareness in the community about sex work. To this end, we provide sex workers with various information guides on topics such as law, taxation, health, and safety.

Unlike purely advertising portals, BUNNIZ offers a free community network. For us, the focus is on the community, within which members meet, support each other, and grow.

Behind BUNNIZ is a great team of real people who believe in this project and are passionate about working for, and with the community. We consider ourselves a positive platform for sex work. Our employees and partners work with the intention of positively changing society's view of sex work and eliminating stigmatization.

2. Search and booking

i. Search

You can search for sexual services using criteria such as type of service, location, or hours. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria.

ii. Booking

To use our platform, creating a user profile is required. This registration is done simply by filling out our online registration form. It is strictly forbidden to create and/or use more than one user profile, even under different names. Duplicates will be automatically removed. When you book a Listing, you agree to pay all fees related to your booking, including the price of the service set out in the Listing, applicable fees such as BUNNIZ service fees, taxes, and any other items identified during checkout (collectively, the “Total Fees”). Please note that the choice of certain payment methods may impact the immediate execution of services. When you receive the booking confirmation, a service contract (a “Reservation”) is formed directly between you and the provider. In addition to these Terms, you will be subject to and responsible for complying with all of the terms of the Reservation, including, but not limited to, cancellation policies and all other rules, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, policies, and requirements before booking a Listing. It is possible that some Providers work with a co-provider or as part of a team to provide their services. If you stay beyond the departure time, the provider has the right to make you leave in a manner consistent with applicable law, including imposing reasonable penalties for undue service extension. You may not exceed the maximum allowable number of Clients.

3. Cancellation, Refund, Modification of Reservation

i. Cancellations, Refunds

Generally, if you cancel a reservation, the amount refunded to you is determined by the applicable cancellation policy for that reservation. However, in certain situations, other conditions take priority and determine the amount refunded to you. If an event beyond your control forces you to cancel a reservation, you are eligible for a full refund under our policy for force majeure cases. If the Provider cancels or if you encounter an issue related to a service, you may be eligible for assistance with a new reservation, or a partial or full refund. You may appeal a decision by BUNNIZ by contacting our user support.

ii. Reservation modifications

Providers and clients are responsible for any Reservation Modifications that they agree to make through the BUNNIZ Platform or request the BUNNIZ customer service to make on their behalf (“Reservation Modifications”), and agree to pay any additional amounts, fees or taxes associated with any Reservation Modification.

4. Liability

You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any person you invite to join you (or to whom you provide access). This means that you should act with integrity, treat others with respect, and comply with applicable laws at all times.

5. Complaint

The User must notify BUNNIZ of any poor execution of services no later than 7 days after becoming aware of the poor execution. This notification must be sent to BUNNIZ in writing and must be sufficiently motivated. The User is only entitled to a remedy in the form of a new execution.

C. Provider Conditions

1. Hosting clients

i. Provider

As a Provider, BUNNIZ grants you the right to use the BUNNIZ Platform to share your Sexual Services with our community of Clients, and to earn money by doing so. Creating an Advertisement is very easy. You control how you host Clients, set your services and price, availability and rules for each Advertisement.

ii. Agreement with Clients

When you accept a booking request on the BUNNIZ platform, you enter into a contract directly with the Client and are responsible for providing the Sexual Service according to the conditions and price specified in your Listing. You also agree to pay any applicable fees such as BUNNIZ service fees (and applicable taxes) for each booking. Any additional terms or conditions that you include in a separate contract with the Client must: (i) be in compliance with these Terms and the information provided in your Listing, and (ii) be clearly disclosed in the description of your Listing.

iii. Independence of Providers

Your relationship with BUNNIZ is that of an independent entity or individual and not an employee, agent, co-entrepreneur, or partner of BUNNIZ. BUNNIZ exercises no control over your Sexual Service. You understand that you have full discretion to decide if and when you wish to provide Sexual Services, and at what price and under what conditions to offer them.

2. Listing Management

i. Creating and Managing Your Listing

To make use of our advertising spaces, the creation of a user profile is required. This registration is done simply by filling out our online registration form. It is strictly forbidden to create and/or use more than one user profile, even under different names. Duplicates will be automatically deleted. The BUNNIZ Platform provides tools that allow you to easily configure and manage an Ad. Your Ad must include complete and accurate information about your Services, your price, any other fees such as fees charged in person, and any rules or requirements that apply to your Clients or your Ad. You are responsible for your own acts and omissions, as well as for updating and ensuring the accuracy of the information in your Ad (including the availability dates on your calendar) and its content (such as photos) at any time. We recommend that you take out appropriate insurance for your Sexual Services, the terms and conditions of which we also suggest you read carefully, including coverage and exclusions.

ii. Understanding Your Legal Obligations

You are required to understand and comply with all laws, regulations, rules and contracts with third parties that apply to your Ad or Sexual Services. Some local communities, including cities, require Providers to complete administrative formalities before providing certain Sexual Services. In some places, the Sexual Services you may want to offer may be prohibited. Check national and local regulations to know the rules that apply to the Sexual Services you plan to offer. The information we provide regarding legal requirements is for informational purposes only. You must independently verify your obligations. You are responsible for the processing and use of Clients' and other persons' personal data in accordance with privacy laws and these Terms, including our applicable Provider privacy policy. If you have any questions about how local legislation applies, you should always consult a legal adviser.

iii. Ranking in search results

The ranking of Ads in search results on the BUNNIZ Platform depends on several factors, mainly the following:

iv. Your responsibilities

You are responsible for your own actions and omissions as well as those of the individuals you authorize to participate in providing your Sexual Services. You are responsible for your rates, settlement, and requirements of your advertisement. You must describe all fees and charges in the description of your advertisement, but you may not collect fees or charge for additional items outside of the BUNNIZ Platform. Do not encourage Clients to create third-party accounts, submit reviews, provide their contact information, or take other actions outside of the BUNNIZ Platform.

v. Client Welcoming as a Team or Organization

If you work as a member of a team, a company, or another organization, the entity and each individual who participates in providing Sexual Services are responsible as a Provider under these Terms. If you agree to terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for your team, company, or any other organization and that each entity you use is in compliance with the laws of the jurisdiction in which it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you ask BUNNIZ to transfer a portion of your payment to a colleague or to send payments to a third party, you must be authorized to do so. You are responsible for the amounts of the payments and the accuracy of the information you provide.

3. Cancellation, Performance Issues, and Modifications

i. Cancellation and Performance Issues

In general, if a Client cancels a reservation, the amount paid to you is determined by the cancellation policy applicable to that reservation. If you cancel a Client's reservation without a valid reason, we may impose cancellation fees and other consequences. If: (i) a Client experiences a performance issue, (ii) a force majeure event occurs, or (iii) a reservation is cancelled, the amount paid to you is reduced by the amount we refund or provide to the Client, and any other reasonable fees we incur as a result of the cancellation. If a Client receives a refund while you have already been paid, or if the amount of the refund and other fees incurred by BUNNIZ exceeds your payment, BUNNIZ may recover that amount from you, including by deducting the refund from your future payments. You agree that the customer refund policy, the force majeure policy, and these BUNNIZ terms and conditions prevail over the cancellation policy in situations where they permit cancellation of a reservation and/or issuance of refunds to Clients. If we reasonably anticipate refunding a Client under one of these policies, we may hold any payment for that reservation until a refund decision is made. You may appeal a decision by contacting our user support.

ii. Reservation Modifications

Providers and Clients are responsible for any Reservation Modification they agree to make on the BUNNIZ Platform or request the BUNNIZ customer service to make on their behalf, and agree to pay any additional amounts, fees, or taxes associated with a Reservation Modification.

4. Taxes

As a provider, you are responsible for determining and fulfilling your obligations under applicable laws to declare, collect, remit, or include in your price any VAT or other indirect taxes, income taxes, or other applicable taxes (“Taxes”).

D. Terms and Conditions

1. Majority

Our offer is exclusively addressed to adults, legal entities, and partnerships. Minors are not allowed to visit or register on the BUNNIZ website.

2. Comments

After each Provider Service, Clients and Providers have the opportunity to leave each other a comment. Your Comment must be accurate, constructive, and cannot contain any discriminatory, offensive, defamatory or other comments. BUNNIZ reserves the right to verify and remove content containing the aforementioned comments, it being understood that this is a non-exhaustive list.

3. Content

Certain parts of the BUNNIZ Platform allow you to provide comments, text, photos, audio, video, information and other content (“Content”). This Content will only be used if such use is in compliance with applicable data protection laws in accordance with our privacy policy. You are solely responsible for any Content that you provide and warrant that you either own it or are authorized to grant BUNNIZ the rights described in these Terms. You are responsible if any of your Content violates or infringes on the intellectual property or privacy rights of a third party. Content must comply with our content policy, which prohibits, among other things, discriminatory, harassing, deceptive, violent, and illegal content. In any case, it is strictly prohibited to publish the following content on the site:

• Any content that violates the intellectual property rights or image rights of other users and/or third parties.
• Any content that results from, refers to, and/or encourages the commission of criminal offenses.
• The dissemination of content that may cause harm to other users of the website. It is notably prohibited to transmit malicious software, such as computer viruses, malware, worms, trojans, and cancelbots.

You agree that BUNNIZ may make available services or automated tools to translate the Content and that your Content may be translated using these services or tools. BUNNIZ does not guarantee the accuracy or quality of these translations, and it is up to Members to verify the accuracy of these translations. We strive to offer a quality site, but for this purpose, we need the help of our visitors. If we receive a motivated message reporting inappropriate and/or illegal content, we will take all appropriate measures. Therefore, please keep us informed if you disagree with the content, information or advertisements on our site by emailing BUNNIZ.

4. Verification

In principle, the operator does not verify the content uploaded by users on the portal and therefore cannot guarantee its accuracy, relevance, and quality. Users have the possibility to become a “verified BUNNIZ member” or to have an “authenticity check” carried out by the BUNNIZ team. To do so, users must prove their identity in an appropriate form, for example, by presenting an identity card or another appropriate method.

5. Prices

Registration on BUNNIZ and the use of the BUNNIZ portal are free of charge. Certain functions of the website are chargeable and can only be used by members after completing a paid membership. The paid options are clearly identified as such and can only be activated by the user after confirmation. All prices are quoted in EURO and include VAT and other taxes. Obvious and/or obvious errors in our prices can always be corrected after the conclusion of the contract. Any additional fees, such as those related to the use of certain payment methods, are always clearly communicated in advance to the User and are entirely at their expense. Online orders can be paid using globally recognized and accepted electronic payment methods. The terms of use of the chosen payment provider will then exclusively apply. Therefore, we accept the following payment methods:

• PayPal
• Bank transfer
• Stripe

6. Fees

BUNNIZ may charge fees (and applicable taxes) to Providers and Clients for the right to use the BUNNIZ Platform. All applicable fees are disclosed to Providers prior to posting a Listing and to Clients prior to booking. To learn more about applicable service fees and how they are calculated, please visit our service fee page. Unless otherwise stated on the BUNNIZ Platform, service fees are non-refundable.

7. Bunniz Rules

i. Regulations

You must comply with these rules and must not assist or encourage others to violate or circumvent them.

• Act with integrity and treat others with respect
• Not to lie, misrepresent something or someone, or pretend to be someone else.
• Show politeness and respect when communicating or interacting with others.
• Not to discriminate against or harass others.
• Do not damage, hack, reverse engineer, compromise, or alter the BUNNIZ Platform.
• Do not use robots, crawlers, scrapers, or other automated means to access data or other Content or retrieve them from the BUNNIZ Platform or to interact with it.
• Do not hack, bypass, delete, alter, or attempt to circumvent any security or technological measure used to protect the BUNNIZ Platform or Content.
• Do not decipher, decompile, disassemble, or reverse engineer any software or hardware used to provide the BUNNIZ Platform.
• Do not take any action that could disrupt or harm the performance or proper functioning of the BUNNIZ Platform.
• Do not use the BUNNIZ Platform outside the scope of these Terms or any other contract established with BUNNIZ.
• You may only use another Member's personal information to the extent necessary to facilitate a transaction using the BUNNIZ Platform, as authorized by these Terms.
• Do not use the BUNNIZ Platform, our messaging tools, or Members' personal information to send commercial messages without the recipient's explicit consent.
• Use the Content made available by the BUNNIZ Platform only as necessary to enable you to use the BUNNIZ Platform as a Client or Provider.
• Do not use the Content unless you have permission from the owner of the Content or the use is authorized by us in these terms or in another contract you have established with BUNNIZ.
• Do not request, make, or accept a Reservation or Payment outside of the BUNNIZ Platform to avoid paying fees, taxes, or for any other reason.
• Do not require or encourage Clients to open an account, leave a review, or interact in any other way with a third-party website, application, or service before, during, or after a reservation, except as authorized by BUNNIZ.
• Do not attempt to manipulate our search algorithm.
• Do not book Sexual Services unless you actually intend to use those services.
• Do not use, copy, display or frame the BUNNIZ Platform, any Content, any BUNNIZ trademark, or any layout or design without our consent.
• Comply with your legal obligations
• Understand and comply with the laws that apply to you, including privacy laws, data protection laws, and export laws.
• If you provide us with personal information about another person: (i) you must do so in compliance with applicable law, (ii) you must be authorized to do so, and (iii) you authorize us to process that information in accordance with our privacy policy.
• Read and comply with these Terms.
• Do not organize or facilitate unauthorized parties or events. You are responsible for any party or event during your booking.
• Do not use the name, logo, trademark, or service marks of BUNNIZ or other individuals without permission.
• Do not use or register a domain name, social media handle, trade name, trademark, logo, or any other source identifier that could be confused with the BUNNIZ trademark.
• Do not offer Sexual Services that violate laws or contracts that apply to you.

Do not offer or solicit services related to prostitution or participate in human trafficking and exploitation of minors or facilitate them.

ii. Reporting a violation

If you believe that a Member, an Advertisement or Content presents an imminent risk of harm to a person, you must immediately contact local authorities before contacting BUNNIZ. In addition, if you believe that a Member, an Advertisement or Content constitutes a breach of these General Terms and Conditions, you must notify BUNNIZ of your concerns. If you have reported a problem to local authorities, BUNNIZ may request a copy of that report. Unless required by law, we are not obligated to take action in response to a report.

iii. Copyright Notifications

If you believe that any Content on the BUNNIZ Platform violates copyright, please notify us.

8. Termination, Suspension and Other Measures

i. Duration

The contract between you and BUNNIZ reflected by these Terms remains in effect until you or we terminate the contract in accordance with these Terms.

ii. Termination

You may terminate this agreement at any time by sending us an email or deleting your account. BUNNIZ may terminate this agreement for any reason by giving you 30 days' notice by email or using any other contact information you have provided for your account. BUNNIZ may also terminate this agreement immediately and without notice and cease providing access to the BUNNIZ Platform if (i) you materially breach these Conditions, if (ii) you violate applicable laws, or if (iii) such action is necessary to protect the personal safety or property of BUNNIZ, its Members, or third parties (for example, in the case of fraudulent behavior by a Member), or if (iv) your account has been inactive for more than two years.

iii. Offenses committed by a Member

If (i) you violate these Conditions, if (ii) you violate applicable laws, regulations, or the rights of third parties, if (iii) you have received multiple negative reviews or if BUNNIZ becomes aware of or receives complaints regarding your performance or conduct, if (iv) you have repeatedly canceled confirmed bookings or failed to respond to booking requests without a valid reason, or if (v) such action is necessary to protect the personal safety or property of BUNNIZ, its Members, or third parties, BUNNIZ may:

• suspend or limit your access to the BUNNIZ Platform or your account or its use;
• suspend or remove Listings, Comments, or any other Content;
• cancel ongoing or confirmed bookings; or
• suspend or revoke any special status associated with your account.

In the case of minor offenses or where appropriate, you will be informed of any action BUNNIZ is considering and will have the opportunity to remedy the problem, unless such notification (i) would prevent or hinder the detection or prevention of fraud or other illegal activities involved, (ii) would harm the legitimate interests of other Members or third parties, or (iii) would violate applicable laws.

iv. Legal warrants

BUNNIZ may take any measures it reasonably deems necessary to comply with applicable law, or a decision of a court or any other duly authorized judicial, administrative or police authority.

v. Effect of Termination

If you are a Service Provider and terminate your BUNNIZ account, all confirmed bookings will be automatically canceled and your Clients will receive a full refund. If you delete your BUNNIZ account as a Client, all confirmed bookings will be automatically canceled and any refund will depend on the cancellation conditions of the Listing. In the event of termination of this agreement, you are not entitled to restore your account or content. If your access to the BUNNIZ Platform or its use has been limited, if your BUNNIZ account has been suspended, or this agreement has been terminated by us, you cannot register a new account or access the BUNNIZ Platform or use it through another Member's account.

vi. Appeal

You may appeal a decision made by BUNNIZ by contacting our customer service.

9. Modification of the Terms

BUNNIZ reserves the right to adapt or modify the terms of use at any time. We will send you all important modifications by email at least thirty (30) days before their effective date. If the proposed modifications to these Terms are significant, you will be asked to explicitly accept the revised Terms. This notice will also inform you of your right to refuse the proposed modifications, the deadline to do so, and your right to terminate the agreement at any time before the effective date of the proposed modifications, as provided in these Terms. In the case of (i) non-material modifications to these Terms that do not affect their essential provisions, or (ii) modifications required by law, a legally binding court decision or a binding order from a competent authority, your continued use of the BUNNIZ Platform after the effective date of the proposed modifications shall constitute acceptance of the revised Terms.

10. Role of BUNNIZ

Our website is a service platform characterized by adult content. We offer you the right to use a platform allowing Members to publish, offer, search for and book Sexual Services. When Members make or accept a reservation, they enter into a contract directly with each other. BUNNIZ is not and does not become a party to any contract entered into between Members. BUNNIZ does not act as an agent for any Member. Although we do our utmost to ensure that our Members have excellent experiences with BUNNIZ, we do not control and cannot control the conduct of Clients and Providers and we do not guarantee (i) the existence, quality, safety, relevance or legality of Ads or Sexual Services or (ii) the truthfulness or accuracy of Ad descriptions, comments or other Content provided by Members. You acknowledge that BUNNIZ has no obligation to monitor the use of the BUNNIZ Platform and verify information provided by our Members, but has the right to verify Content, disable its access, remove or modify it to: (i) operate, secure and improve the BUNNIZ Platform (including for fraud prevention, combating human trafficking, child exploitation, risk assessment, investigations or customer service); (ii) ensure compliance by Members with these Terms; (iii) comply with applicable law or the decision of a duly authorized court or administrative, judicial or police authority; (iv) process Content that we determine to be harmful or objectionable; (v) take the actions set forth in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Ads that do not meet quality and eligibility criteria. When BUNNIZ removes or disables Member Content, BUNNIZ informs the Member and provides reasons for the decision unless such notification (i) hinders or obstructs the discovery of fraud or other illegal activity, (ii) harms the legitimate interests of other Members or third parties, or (ii) violates applicable law. You may appeal this decision by contacting our customer service. Members agree to cooperate with BUNNIZ and to assist BUNNIZ in good faith in providing BUNNIZ with the information requested and taking reasonable measures requested by BUNNIZ in connection with any investigation conducted by BUNNIZ into the use or misuse of the BUNNIZ Platform.

11. Member Accounts

You must create an account to access many features of the BUNNIZ Platform and use them. You declare and warrant that you are not a person or entity prohibited from using the BUNNIZ Platform under these Terms and Conditions, the laws of Belgium, or any other relevant jurisdiction. You must provide accurate and complete information when registering, and keep your account information up to date. You may not create more than one account or transfer your account to anyone else. It is your responsibility to preserve the confidentiality and security of your account credentials, and you are prohibited from disclosing your credentials to any third party. You must immediately inform BUNNIZ if you suspect that your credentials have been lost, stolen, or otherwise compromised. You are responsible for all activities conducted with your BUNNIZ Account, unless you have not authorized such activities and have not otherwise been negligent (e.g., by failing to report unauthorized use or loss of your credentials). If permitted by applicable law, we may, but have no obligation to, (i) ask you to provide identification or other information, (ii) undertake verifications to help verify your identity or background, (iii) compare you to third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registries or their local equivalents.

12. Disclaimer of Liability

We do not endorse or warrant the existence, conduct, performance, safety, quality, legality, or suitability of any Client, Provider, Sexual Service, Ad, or third party. Verifying users on the Internet is difficult, and we do not guarantee that any verification, identity or background checks conducted on Members (if any) will identify past misconduct or prevent future misconduct. All references to a 'Verified' Member (or similar term) only mean that the Member or BUNNIZ has undergone an appropriate verification or identification process, and nothing else. We are not liable for any Internet or telecommunications infrastructure failures or outages that are beyond our control and may result in interruptions in the accessibility of the BUNNIZ Platform. BUNNIZ may, temporarily and taking into account the legitimate interests of Members (for example, with prior notice), limit the availability of the BUNNIZ Platform or certain features of the BUNNIZ Platform if necessary due to limited capacity, to preserve the security or integrity of our servers, or to perform maintenance operations to ensure the proper functioning or improve the functioning of the BUNNIZ Platform.

13. Liability

BUNNIZ may be held liable under applicable legal provisions in case of intentional and gross misconduct committed by us, our legal representatives, directors, or agents. The same applies to the assumption of guarantees or any other strict liability or in case of harm to life, physical integrity, or health. In case of breaches of contractual obligations committed by us, our legal representatives, directors, or agents, BUNNIZ's liability is limited to typical foreseeable damages that may arise. Contractual obligations are the obligations of BUNNIZ that you expect to be fulfilled for the proper performance of the contract. Any other liability of BUNNIZ is excluded.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at BUNNIZ's option), indemnify, and hold BUNNIZ harmless from and against any and all claims, liabilities, damages, losses, and expenses, including, without limitation, compensatory, direct, incidental, consequential, exemplary, and other damages (including attorneys' fees), arising out of or in connection with: (i) your breach of these Terms (including any additional or supplemental terms that apply to a product or feature and are presented to you before you access such product or feature), (ii) your improper use of the BUNNIZ Platform, (iii) your interaction with any Member, participation in any other Sexual Service, including but not limited to any harm, loss, or damage (compensatory, direct, incidental, consequential, exemplary, and other damages) of any kind arising in connection with or as a result of an Ad, appointment, participation or use of such service, (iv) your failure, or our failure at your instruction, to accurately declare, collect, or remit taxes, or (v) your violation of any law or regulation or the rights of any third party, such as intellectual property or privacy rights. This indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses are actually caused by your culpable breach of a contractual obligation.

15. Applicable Law

These Terms are governed and interpreted in accordance with Belgian law. As a consumer, you may bring any legal action related to these Terms before the competent court. If BUNNIZ wishes to enforce its rights against you as a consumer, we can only do so in the courts of the jurisdiction to which you belong. If you act as a professional, you agree to submit to the exclusive jurisdiction of the Belgian courts.

16. Miscellaneous

i. Interpretation of these Conditions

Unless they may be supplemented by additional conditions, terms, policies, guidelines, and product disclosures, these Conditions constitute the entire agreement between BUNNIZ and you with respect to your access to or use of the BUNNIZ Platform and supersede all prior or contemporaneous agreements, whether oral or written, between BUNNIZ and you. These Conditions do not confer and are not intended to confer any rights or remedies upon any person other than you and BUNNIZ. If any provision of these Conditions is held to be invalid or unenforceable, such provision shall be struck and shall not affect the validity and enforceability of the remaining provisions.

ii. No Waiver

BUNNIZ's failure to enforce any right or provision of these Conditions will not be deemed a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Conditions, the exercise by either party of any of its remedies under these Conditions will be without prejudice to its other remedies under these Conditions or otherwise available at law.

iii. Assignment

You may not assign, transfer, or delegate this Agreement or your rights and obligations under these Conditions without the prior written consent of BUNNIZ. BUNNIZ may, without restriction and at its sole discretion, assign, transfer, or delegate this Agreement and any rights and obligations hereunder upon 30 days' prior notice. You retain the right to terminate the Conditions at any time in accordance with section 8.2.

iv. Notice

Unless otherwise stated, all notices or other communications permitted or required by these Terms, and intended for Members, must be made electronically and delivered by BUNNIZ via email, notification on the BUNNIZ Platform, or messaging service (including SMS), or any other contact method we provide to you.

v. Third-Party Services

The BUNNIZ Platform may contain links to third-party websites, applications, services, or resources ('Third-Party Services'). These are services over which we have no control, and which are subject to different terms and privacy practices. BUNNIZ is not responsible for any aspect of these Third-Party Services and the links to these Third-Party Services are not an endorsement. Any visit and use of these links are always at the User's own risk. If an advertisement contains a link, the content of the site to which it is referred must be related to that of the advertisement. This link cannot contain advertising related to third-party profile sites. Profile site accounts are not considered as a separate site.

vi. Google's Terms and Conditions

Some translations on the BUNNIZ Platform are provided by Google. Google disclaims all warranties related to the translations, explicit or implicit, including any warranty of accuracy, reliability, and any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. Some parts of the BUNNIZ Platform use Google Maps/Google Earth mapping services, including Google Maps APIs. Your use of Google Maps/Earth is subject to the additional terms of use for Google Maps/Google Earth.

vii. Content of the BUNNIZ Platform

The Content made available by the BUNNIZ Platform may be protected by copyright, trademarks, and/or other laws of Belgium and the EU. You acknowledge that all intellectual property rights to such Content are the exclusive property of BUNNIZ and/or its licensors, and agree not to remove, alter, or conceal any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Content accessible through the BUNNIZ Platform except as expressly authorized in these Terms or by the legal owner of such Content. Subject to your compliance with these Terms, BUNNIZ grants you a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to (i) download and use the Application on your personal device(s), and (ii) access and view the Content made available on or through the BUNNIZ Platform, solely for your personal and non-commercial use.

viii. Force Majeure

BUNNIZ shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or diseases, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

ix. Right of Withdrawal

As a consumer user, you have the right to cancel the purchase. You can request a refund up to 14 days after the purchase, and you can cancel the contract without giving any reason. If you wish to exercise your right of withdrawal, please inform us. You can do this by sending an email to contact@bunniz.be or through the contact form on the website.

x. Emails and SMS

You will receive communications from us at your email address or other contact information you provided when creating your BUNNIZ account. Enrolling in programs involving email delivery will not affect the frequency of these communications, but you should expect to receive additional emails specific to the programs you have subscribed to. We may also send you promotional emails. No fees are charged for these promotional emails. You can control the promotional emails you receive by accessing notification preferences in your account settings. Please note that you may not be able to take advantage of certain promotions if you disable certain communication settings or do not have a BUNNIZ account.
